  1. These terms and conditions (The “Terms and Conditions”) apply to the promotion set out in Clause 3 below (the “Promotion”). By participating in the Promotion, participants agree to be bound by these Rules. All capitalised but undefined terms herein shall be deemed to have the same meaning as given to such terms in your agreement contract.
  2. The promotion is organised by Canopy (Co. Reg. No. 201421992W) with its registered address being 151 Chin Swee Road, #04-08 Manhattan House, Singapore 169876.
  3. This Promotion provides a set of Oculus Go 32GB worth USD 199 for clients opening new accounts with Canopy in accordance with these Terms and Conditions.

Eligibility

  1. To be eligible to take part in the Promotion (a “Qualifying Participant”) you must satisfy the following terms:
    1. You must apply to open a Canopy account between (and including) 28 January 2019 and 28 February 2019 (the “qualifying Period”) and proceed to successfully open such account subsequent to Canopy’s procedure;
    2. You must accept the Terms and Conditions of the Promotion;
    3. You must not already have an account with Canopy or any of its Associated Companies;
    4. You must not be an employee (or any relation or partner of agent thereof) Canopy; and
    5. You must not be a participant or have accepted any other concurrent promotion offered by Canopy.
  2. By accepting and proceeding with this Promotion, you have agreed to be bound by these Rules as well as the relevant contract agreement for your Canopy account. If any provision of these Terms and Conditions conflicts with any provision of your contract agreement, the contract agreement shall prevail.

Promotion Details

  1. If you are a Qualifying Participant, we will send you a set of Oculus Go to the mailing address provided subject to the following:
    1. Your min subscription must be 1 year with a minimum amount equal to or greater than USD 5000, during the Qualifying Period;
    2. You must be fully authorised to operate your Canopy account. For the avoidance of doubt, you must be the account holder of the Canopy account and not be participating in the Promotion on behalf of a third party;
    3. Unless otherwise stated, all dates are determined in accordance to Singapore time; and
    4. This Promotion only valid once for each Qualifying Participant.

General

  1. We are the sole arbiter of the Promotion, these Terms and Conditions and any other issues arising under this Promotion. Exceptions to these Terms and Conditions are at the sole discretion of Canopy’s management, and our decision is final. We reserve the right to alter, amend or terminate the Promotion or any aspect of it at any time and without prior notice.
  2. Any dispute or situation not covered by the terms of this Promotion will be resolved by our management in a manner it deems to be fairest to all concerned and that decision shall be final and binding on all parties. We reserve the rights to refuse to give out the Oculus Go under the Promotion if we have reasonable belief that the Promotion is being abused in any way.
  3. If at any time all or any part of any provision of these Terms and Conditions are or become illegal, invalid or unenforceable in any respect under the law of any jurisdiction, such provision(s) shall not affect or impair the legality, validity or enforceability in that jurisdiction of the reminder of that provision or all other provisions of these Terms and Conditions or the legality, validity or enforceability under the law of any other jurisdiction of that provision of these Terms and Conditions.
  4. These Terms and Conditions shall be governed by and constructed in accordance with laws of Singapore and shall be subject to the jurisdiction of the Singaporean courts.
